Terms for accounts, AI image services, credits, and payments on imgthree.

Operator and Staging Status

imgthree is a product operated by the imgthree team. Legal and privacy inquiries may be sent to privacy@imgthree.com, and product support requests may be sent to support@imgthree.com.

Staging notice: These terms currently govern the imgthree staging service for testing and evaluation. The legal operator name and address required for a Production launch have not yet been published. Production availability will require updated operator information and terms.

By creating an account or using imgthree, you agree to these Terms. If you do not agree, do not use the service.

The Service

imgthree provides credit-based AI image generation and editing, related chat coordination, and image history and storage. Features, models, credit costs, limits, and availability may change. We may suspend a feature or the service for security, legal, provider, or operational reasons.

AI services are probabilistic. Outputs may be inaccurate, unsuitable, similar to other outputs, or subject to third-party rights. imgthree does not guarantee that an output is unique, error-free, fit for a particular purpose, or legally safe for every intended use. You are responsible for reviewing outputs before using or publishing them.

Accounts

You must provide accurate account information, protect your credentials, and promptly report suspected unauthorized access. Free welcome credits are issued only after successful email verification and at most once per eligible user.

imgthree does not currently offer self-service account deletion. Account deletion requests must be sent from the account email address to privacy@imgthree.com. Deleting an account does not automatically cancel a subscription or create a refund.

Your Content

You retain any rights you already hold in prompts, uploads, and other content you submit. You grant imgthree and its service providers the limited rights needed to receive, process, transmit, store, and display that content to operate the service.

You must have the rights and permissions needed for content you upload and for your intended use of outputs. Do not upload or generate content that is unlawful, infringes intellectual property, privacy, publicity, or other rights, or contains harmful, abusive, deceptive, or exploitative material.

Acceptable Use

You may not:

  • violate law or third-party rights;
  • access another account or restricted system without authorization;
  • bypass credit, rate-limit, authentication, payment, or safety controls;
  • disrupt the service, distribute malware or spam, or conduct abusive automated activity;
  • misrepresent AI output in a way that unlawfully deceives or harms others; or
  • use imgthree in a way that creates material risk for users, providers, or the service.

We may restrict or suspend access when reasonably necessary to investigate or stop a violation, protect the service, or comply with provider or legal requirements.

Credits

Credits are service-use units, not money, stored value, or transferable property. The price, quantity, model cost, and validity shown at purchase or grant apply.

The current V1 policy is:

  • verified-email welcome grant: 120 Credits, issued once, valid for 7 days;
  • monthly subscription credits: valid for 30 days;
  • annual subscription credits: valid for 365 days; and
  • one-time credit packs: valid for 365 days.

Credits are consumed when an image task is accepted for processing. If an image task fails under the service's failure-handling flow, its pre-authorized credits are returned automatically. Expired credits cannot be used. Promotional or welcome credits have no cash value and are not refundable.

Payments, Subscriptions, and Refunds

Creem acts as Merchant of Record for paid checkout. Creem processes payment details, applicable taxes, subscriptions, and payment receipts under its buyer terms and notices. imgthree does not store full payment-card numbers or calculate transaction tax itself.

Subscriptions renew automatically for the selected billing period until canceled. A scheduled cancellation takes effect at the end of the current paid period; service and current-period benefits normally remain available until then.

You may request a refund for a purchase whose purchased credits remain completely unused. Refund eligibility and handling are subject to applicable law, Creem's rules, transaction status, and abuse prevention. Used or expired credits and promotional or welcome credits are not refundable except where required by law. Contact support@imgthree.com for assistance.

Account deletion is separate from subscription cancellation and refund requests. Cancel an active subscription through the available billing flow before requesting account deletion.

Intellectual Property

imgthree's software, interface, branding, and service materials are protected by applicable intellectual-property laws and licenses. The service includes licensed ShipAny components; ShipAny retains the rights described in the repository's applicable license and attribution notices. These Terms do not transfer ownership of imgthree or third-party technology to you.

Ownership and permitted use of AI-generated output may depend on your input, applicable law, and provider terms. You are responsible for determining whether your intended use is permitted.

Disclaimers and Liability

To the extent permitted by applicable law, imgthree is provided on an “as is” and “as available” basis without warranties that the service will be uninterrupted, error-free, or suitable for every purpose. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

To the maximum extent permitted by law, the imgthree team will not be liable for indirect, incidental, special, consequential, or punitive loss arising from use of or inability to use the service, AI output, or third-party providers.

Changes

We may update these Terms as the service, providers, business details, or legal requirements change. We will update the date above and provide additional notice where required. Continued use after an effective update means you accept the revised Terms.
